Terms of Service

Welcome to Ziousify. These Terms of Service (“Terms”) govern your use of the website ziousify.com and the services provided by Zious Traders (referred to as “Ziousify,” “we,” “us,” or “our”). By accessing or using our website and services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Services Description

Ziousify provides digital services including but not limited to:

  • Custom web development and web application development
  • UI/UX design and brand identity
  • E-commerce development and integration
  • Search engine optimization (SEO)
  • Digital marketing and social media management
  • Website maintenance and support

The specific scope, deliverables, timelines, and pricing for each project will be outlined in a separate proposal or agreement between Ziousify and the client.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information necessary for the project
  • Respond to communications and feedback requests in a timely manner
  • Provide all required content, assets, and approvals as agreed upon
  • Ensure that all materials provided do not infringe on third-party rights
  • Make payments according to the agreed-upon schedule

4. Intellectual Property Rights

Unless otherwise specified in a written agreement:

  • Client Content: You retain ownership of all original content, images, logos, and materials you provide to us for use in your project.
  • Deliverables: Upon full payment, ownership of the final deliverables (website, design files, etc.) transfers to the client.
  • Pre-existing Materials: Ziousify retains ownership of all pre-existing tools, frameworks, libraries, and proprietary code used in the development process.
  • Portfolio Rights: Ziousify reserves the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed.

5. Payment Terms

  • Payment terms and schedules will be specified in the project proposal or contract
  • A deposit may be required before work commences
  • All invoices are due within the timeframe specified (typically 14 days)
  • Late payments may incur additional fees and/or suspension of services
  • All prices are quoted in the currency specified in the proposal

6. Project Timelines

While we strive to deliver projects within agreed-upon timelines, delays may occur due to factors beyond our control, including but not limited to: late client feedback, delayed content delivery, scope changes, or third-party dependencies. Ziousify will communicate any expected delays promptly.

7. Revisions & Changes

The number of included revisions will be specified in the project proposal. Additional revisions or scope changes beyond the agreed-upon scope may incur additional charges. Major scope changes will require a revised proposal and timeline.

8. Limitation of Liability

To the maximum extent permitted by law, Ziousify and Zious Traders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to our services, even if advised of the possibility of such damages.

Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

9. Termination

Either party may terminate the engagement with written notice. In the event of termination:

  • The client will be invoiced for all work completed up to the date of termination
  • Any deposits paid are non-refundable unless otherwise agreed
  • Ziousify will deliver all completed work to the client upon receipt of outstanding payments

10. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of the agreement.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.
